Montana Auto Insurance

Required Coverage Minimum - 25/50/10. Montana auto insurance regulation mandates that every motorist registering and operating a motor vehicle in Montana must purchase insurance policies with a minimum coverage limit of $25,000 for injury liability for one person in an accident, $50,000 for all injuries in a single accident, and $10,000 for property damage. Since these limits are relatively low, it is recommended to obtain higher limits to protect your assets if you get sued for liability.

Mandatory Insurance Coverage - The required liability insurance coverage is a Property Damage Liability policy and Bodily Injury Liability policy.

Optional Coverage - Although not required, Uninsured Motorist, Underinsured Motorist, Collision, and Comprehensive policies are considered prudent to obtain should you be struck by a motorist with inadequate insurance, or damage is sustained to your vehicle other than from an accident.

Proof of Insurance - You are required to maintain proof of insurance in your vehicle at all times. Therefore, it is highly recommended that you keep a copy of your car insurance ready. You are also required to notify DMV or state agency for cancellation or non-renewal of your auto insurance policy.

Penalty for failure to obey - The penalty for noncompliance for a first time offense could be a fine of not less than $250, or more than $500, or imprisonment in the county jail not to exceed 10 days, or both. Also you will incur five points against your driving record, which can affect your insurance premiums. A subsequent offense will result in a fine of not less than $350.00, or imprisonment in the county jail not to exceed 10 days or both. Also, suspension of your license plates and registration for 90 days (180 days for 3rd or subsequent offense) will result.

Non - Seatbelt Use - In Montana, you cannot be pulled over for non-seat belt usage. However, if you should get pulled over for another traffic infraction, the penalty for seatbelt non-compliance is a $20 fine per any seat in violation.

Lawsuits - Montana is not a true “No-fault” state. Therefore, there are no restrictions on lawsuits for Tort liability resulting from an accident
